There are some disabilities which are obvious and others, which are just as debilitating but not as obvious. The back can be one of the not-so-obvious pains. Perhaps, PTSD. What does your doctor say? Can your doctor prove your disability and pain, or is nothing visible on X-Ray, CT scan, MRI etc.
The FERS Retirement on disability journey may not be an easy one. You may have to provide medical proof more than once, additional medical exams, and if approved, may be tested, and require providing on-going medical proof. If you are MRA with 30 years, age 60 with 20 years or age 62 with 5 years, you may apply for regular immediate and full retirement, without any medical proof.
If you are successful in providing medical proof, your disability retirement will be 60% year one, 40% year 2 and in the 3rd year, you would receive the retirement annuity you have earned, even if you have not reached MRA.
In the most severe or difficult cases to prove cases, legal counsel may be appropriate. If this pertains to you, we can provide a list of law firms, near your home, that specialize in federal disability retirement claims and may be of huge help and guidance to you.
